DUID Defense

Driving under the influence of alcohol is a major problem in Colorado, but plenty of other substances also make the state’s roads unsafe. Penalties for operating vehicles under the influence of marijuana, prescription medications, and other drugs are just as harsh as those associated with alcohol. For high-quality representation in the midst of DUID charges, turn to Jennifer Watkins of the Watkins Law Firm.

Marijuana and DUID

Recreational and medical use of marijuana is currently legal in the state of Colorado. However, it is illegal to drive under the influence of marijuana. Drivers above the age of 21 are not allowed to have any more than five nanograms of delta 9-tetrahydrocannabinol while operating motor vehicles. Determining the cannabis intake required to reach this level can be challenging due to varying metabolisms and THC potencies.

Prescription Drugs

Although DUID is most commonly associated with such illicit substances as cocaine, LSD, methamphetamine, or heroin, a number of legal prescription drugs can also impair driving, and thus, may be cited in DUID charges. Examples of legal drugs commonly involved in DUID charges include Nyquil, Benadryl, Percoset, and Ambien, among others. In DUID cases involving prescription drugs, it is often the attorney’s job to prove that, although the driver may have been using one of the aforementioned substances at the time of arrest, his or her driving was not impaired.

DUID Penalties

DUID penalties mirror those associated with DUIs. First-time offenders can expect to pay fines of over $600 and spend somewhere between two and 180 days in jail. Additionally, these individuals may be asked to complete over 24 hours of community service. License revocation is rare for first-time offenders, but eight points may be added to each offender’s record, thereby increasing the potential for future license suspension. Those with a history of driving under the influence of drugs or alcohol may face far greater consequences, including months or years of living behind bars.

If you have been accused of driving under the influence of drugs, it is very important to get in touch with a trusted lawyer such as Jennifer Watkins. As a respected Colorado attorney, Jennifer Watkins will help you to achieve reduced charges or a dismissed case.
