DUI and DWAI Defense

If you have been accused of driving under the influence of drugs or alcohol, you may face such harsh repercussions as fines, license revocation, public service hours, mandatory participation in rehabilitation programs, use of interlock ignition devices, and jail time. Given the severity of these consequences, it is especially essential for you to seek legal counsel from a knowledgeable criminal defense attorney such as Jennifer Watkins. If you work with the Watkins Law Firm, you will receive high-quality representation from an attorney with a history of success in DUI law.

DUI Policy in Colorado

DUI penalties vary considerably based on the blood alcohol concentration (BAC) of the driver at the time of the arrest, the number of past offenses, and the presence of other concerning behaviors, such as refusal to submit to a BAC test. In general, first-time offenders spend between 2 and 180 days in jail and pay fines of between $600 and $1,000. Offenders may also be required to complete between 24 and 48 hours of public service. Those with one or two previous DWAI or DUI sentences face up to a full year in jail, as well as one to two years of license suspension and fines of up to $1,500.

DUI Versus DWAI

Driving while ability impaired (DWAI) is very similar to DUI, but typically carries a lesser sentence. Those charged with DWAI generally do not suffer license revocation, but they may receive an administrative penalty of eight points. Further points from other infractions could result in license suspension. To be charged with a DWAI, the intoxicated driver must have a BAC of between 0.05 and 0.08.

Driving Under the Influence of Drugs

Colorado may be more lenient than other states when it comes to drug possession policy, but local laws regarding drug use behind the wheel are very strict. Those charged with DUID typically face the same consequences as those accused of driving under the influence of alcohol. If drivers are later charged with DUI, past DUID charges can influence the severity of future sentences.
